ICE: California's 'Sanctuary State' Law Will Force 'At-Large' Arrests

On Friday, a day after Governor Jerry Brown signed California's so-called "sanctuary state" bill into law, Immigration and Customs Enforcement's acting director issued a response decrying the bill's passage and threatening negative ramifications for California's immigrant communities.

This means Californian law enforcement cannot inquire an individual's immigration status, arrest people on civil immigration warrants, or participate in border patrol activities or joint task forces with the federal government if the primary goal is immigration enforcement. And all law enforcement agencies will have to produce annual reports on their participation in task forces that involve federal agencies, as well as on the people they transfer to immigration authorities.

Brown added that the bill by Senate President Pro Tem Kevin de León does not prohibit sheriffs from granting immigration authorities access to California jails to conduct routine interviews.

54, called by media as the "Sanctuary State" bill, was introduced by Democratic Senate President Pro Tem Kevin de Leon on December 5 previous year, weeks after the 2016 presidential election, to defy Donald Trump's campaign pledge to tighten immigration policy. An estimated 10 million immigrants live in California, about 25 percent of whom are thought to be undocumented. The Trump administration warned against the first-of-its-kind law, but the trendsetting state may have a national impact. The law, in part, strictly limits local law enforcement agencies' collaboration with Immigration and Customs Enforcement (ICE) agency officials to only conviction cases and not during arrests.

SB 54 "will inevitably result in additional collateral arrests, instead of focusing on arrests at jails and prisons where transfers are safer for ICE officers and the community", Homan warned. And he says ICE will likely need to detain Californians out of state, far from their families. It is the signature piece of a package of 11 bills establishing protections for undocumented residents of California.

In anticipation of stepped-up raids, lawmakers passed a collection of other bills aimed at resisting Trump's immigration agenda. Brown said in approving the law.

Last month, federal agents arrested almost 500 immigrants in sanctuary cities and towns, including Baltimore and the District of Columbia, and vowed to return "every week" if they refuse to cooperate.
