Supreme Court dismisses case against Trump's expired travel ban

The high court dismissed (PDF) a challenge by the International Refugee Assistance Project that dealt only with the ban on travel from six Muslim-majority countries, which was replaced on September 24 when it expired, report SCOTUSblog, the New York Times, the Washington Post and USA Today.

On Tuesday, the Supreme Court quashed the appeal decision on the Maryland ruling, with the suspension in Hawaii still valid but its days likely numbered.

An individual case from the 9 Circuit in California was pending because it includes a ban on refugees worldwide.

Trump can "win" simply by following through on the executive order, then declaring it fulfilled before the Court hears the various challenges to the case, cutting the Gordian Knot of legal theories and advancing his policies.

Monday's decision by the U.S. Supreme Court to lift the injunction against most of President Donald Trump's "travel ban" is a major victory - and not just because he will be able to implement the policy, but because the case is only scheduled to be heard in the fall, i.e.in October at the earliest.

U.S. District Judge Derrick Watson intends to rule after the U.S. government files a reply.

Trump furnished a novel command about immigrants last month, and the management had conveyed the court that meant there was no basis for the justices to pass judgment on the old one.

The second ban had prevented travel to the United States from six predominantly Muslim countries: Iran, Libya, Somalia, Sudan, Syria and Yemen.

The American Civil Liberties Union, which brought the 4th Circuit challenge on behalf of the refugee group, had said charges of anti-Muslim discrimination still applied "despite some new window dressing" - a reference to the addition of North Korea and Venezuela.

The 4th Circuit case was brought by the International Refugee Assistance Project, which argued that banning travel from six majority-Muslim countries violated the First Amendment's guarantee of freedom of religion.
