Zarate, a convicted felon who has been deported from the US five times, was accused of fatally shooting the 32-year-old Steinle in July 2015 while she was walking with her father and a friend in San Francisco.

In his opening monologue tonight, Sean Hannity said sanctuary city laws and policies killed Kate Steinle.

The jury found him not guilty of the assault charge but convicted him of the possession charge. "We were the ideal storm for that man". Before the shooting, officials in San Francisco released Garcia Zarate from custody instead of turning him over to immigration authorities.

Despite the national political implications, the San Francisco jury was charged with a more discreet task of criminal culpability for Steinle's death. The bullet ricocheted on the pier's concrete walkway and fatally struck Steinle in the back.

The prosecution said that Garcia Zarate fired a handgun deliberately in Steinle's direction, seeking to harm her or others.

The case came down to a question of intent.

That charge was dismissed by San Francisco prosecutors after he arrived.

San Francisco Deputy District Attorney Diana Garcia said during the trial that she didn't know why Garcia Zarate fired the weapon, but he created a risk of death by bringing the firearm to the pier and twirling around on a chair for at least 20 minutes before he fired.

A Mexican national, Zarate was a seven-time convicted felon who had been deported from the USA five times before the shooting.

Gonzalez said in his closing argument that he knows it's hard to believe Garcia Zarate found an object that turned out to be a weapon, which fired when he picked it up.

Steinle was shot and killed by an illegal immigrant while she was walking on a San Francisco pier with her father in July 2015.

Steinle's story has been prominent in Republicans' push for immigration reform - including a bill passed by the House this summer titled "Kate's Law," which creates harsher punishments for illegal re-entry into the US.

Prosecutors said the verdict was not what they had hoped for, but they respect the decision.

Jim Steinle told the San Francisco Chronicle the family was saddened and shocked by the verdict.

Garcia Zarate's lawyer, Matt Gonzalez, had argued that the defendant wasn't criminally responsible because he found the.40-caliber Sig Sauer and wasn't aware it was a gun when it accidentally went off.

In a response to the verdict, Attorney General Jeff Sessions also released a statement saying despite California's attempt at a murder conviction, Zarate was able to walk away with only one conviction because he was not turned over by San Francisco to Immigration and Customs Enforcement. A federal judge dismissed the family's claims against San Francisco and former Sheriff Ross Mirkarimi earlier this year.
