In this case, the plaintiffs are claiming that the social network illegally used a facial recognition system on photos without users' permission.

According to Donato's decision, the class action will consist of users in the state "for whom Facebook created and stored a face template after June 7, 2011".

Facebook's misuse of their users' biometric information could potentially amount to billions of dollars in damages after a federal judge greenlighted an IL class action suit against the firm's facial recognition feature. The lawsuit alleges that Facebook has collection users' biometric information without consent.

The company has also long argued that it has been "transparent" about the facial-tagging tool and allows users to turn it off and prevent themselves from being suggested in photo tags. In a statement made to Reuters, Facebook was quoted as saying, "We continue to believe the case has no merit and will defend ourselves vigorously".

Facebook can probably recognize that its users' faces are angry.

The company has been trying for years to dismiss the case and even pushed for a legislative proposal that would render the IL law harmless.

Executives from Facebook will appear before an Oireachtas committee later today to consider the use of social media and its potential influence on previous and future elections and referenda.

The technology was suspended for users in Europe in 2012 over privacy fears.

The ruling adds to the privacy woes mounting against Facebook over recent weeks, following disclosures that the personal information of millions of users was harvested by political consultancy firm Cambridge Analytica.

Last week, Facebook CEO and founder Mark Zuckerberg testified on Capitol Hill about the data scandal, the company's data collection practices and the need for new regulation.

This law protects people over information such as fingerprints, retina scans, and facial recognition.

The plaintiffs claim Facebook collects and stores their biometric data without prior notice or consent, the ruling said.

"It really puts Facebook's business model into question, and people might feel differently about what they put online if they feel manipulated by the platform", said Jennifer Krueckeberg, lead researcher at privacy advocacy group Big Brother Watch.
