That's why Brett Kavanaugh, President Trump's new Supreme Court nominee, probably isn't surprised that a certain Minnesota Law Review piece he wrote in 2009 about sitting presidents and indictments is getting plenty of attention.

"We knew with any of the 25 nominees that healthcare and women's health and right to choose would be important", Schumer said, referencing a list of conservative judges drawn up by the Heritage Foundation and the Federalist Society.

He said "that's the accountability that will be lost if Judge Kavanaugh is confirmed".

Judge Kavanaugh, 53, has significant Washington credentials. They have to defend 10 seats in red states and try to pick up two additional seats in order to take control of the Senate.

Judicial Crisis Network, a conservative advocacy group, is already up with ads in states such as North Dakota, West Virginia and in, where three Democratic senators are up for re-election.
